This Terms and Conditions of sale apply for the purchase of products (the “Products”) made on the website shop.cruna.com (the “Site”) owned and managed by Cruna S.r.l. (“Cruna” or the “Seller”). Every user visiting the Site (“User”) is invited to view this Terms and Conditions before completing the purchase of products on the Site (“Order”). The purchase of products on the Site implies the acceptance of this Terms and Conditions
1. INFORMATION ABOUT CRUNA
Cruna is a brand of menswear products, specialised on trousers. All products are entirely handmade in Italy. On the Site, the User can find information about the brand and buy products online.

The purchase of products on this Site is allowed to customers (“Customers”), meaning natural persons, eligible to execute and perform binding agreements according to the applicable law or under parental (or guardian) consent, when needed, outside of any business or professional purpose.
When submitting the Order, Customers must provide all the personal information required by the Site, including but not limited to their own first name, surname, birth date, email, billing and delivery address. All such information must be true, accurate and up to date.
Users cannot make any purchase under someone else’s identity unless strictly authorized to do so by the identity holder.
Products on this Site are not meant for resale.
3. PRODUCT ORDERS AND ACCEPTANCE OF THE CONTRACT
The presentation of the products on the Site is an invitation to tender.
The Order can be made through the Site by selecting any image of the product presented and, in any case, following the steps and instructions specified on the Site. In order to make any changes and/or corrections to the Order, the Customer shall follow the instructions contained on the Site.
The amount of an individual Order cannot exceed 5 items.
The Order will be sent by clicking on the "Proceed with the Order" button and will be stored in the Cruna database for the period of time set forth by the current legislation.
The Order will then be considered a contractual purchase proposal. Upon receipt of the Order, Cruna will send the Customer an email containing the Order number and information about the ordered products, the price of each product, the shipping address as well as the payment methods. This email does not constitute acceptance of the Customer's Purchase Proposal and serves only as confirmation that the Order has been received. Upon receipt of Customer's Order, Cruna will verify the availability of the ordered products as well as the accuracy of the information provided by the Customer.
The sales agreement with Cruna will only be completed by sending a separate email of acceptance for the purchase proposal and/or dispatch confirmation of the ordered products.
The Customer's Order may be refused in the event of an error in the information provided by the Customer if the available products are out of stock, if insufficient solvency warranties are detected, if the Order does not meet the normal need for consumption (a requirement that applies either to the number of products purchased within a single Order or to a plurality of Orders pertaining to the same product, even if each Order comprises a quantity of products corresponding to normal needs of consumption), or due to cases of force majeure.
If the Order cannot be accepted, Cruna will communicate within 10 days following receipt of the Order the impossibility of processing the Order, which will be followed by the immediate release of the payment amount.
The price of the products published on the Site relates to the single item, expressed in Euros and including VAT (“Prices”). Cruna will pay all taxes, duties, charges and/or shipping costs.
Regarding the costs of delivery of the Order (“Delivery Costs”), those, inclusive of VAT, will be visible in the summary of the Order during the checkout procedure. In general, Delivery Costs to Italy are free for all the Orders with a value higher or equal than €150, while for Orders with a value lower than €150, the Delivery Costs in Italy amount to €10 per Order. Delivery Costs to Europe are free for all the Orders with a value higher or equal than €300, while for Orders with a value lower than €150, the Delivery Costs in Italy amount to €20 per Order.
Any amendments made to the Prices will have effect from the date of their publication on the Site, with no retroactive effects on Orders that have already been accepted via Purchase confirmation.
Except in the event of a recognisable error in accordance with article 1431 c.c., the Seller reserves the right to refuse the acceptance of an Order for reason of error in the Price published on the Site or indicated in the email sent to confirm the receipt of the Order, that is, before the acceptance of the same Order by the Seller.
5. PAYMENT CONDITIONS
The Customer can pay by credit card, PayPal or other electronic methods. The following methods are accepted:
- Visa/Visa Electron;
- American Express;
- Maestro International;
- Google Pay;
- Apple Pay.
Delivery of the products is carried out in Italy and in Europe (including Bulgaria, Croatia, Denmark, Poland, United Kingdom, Czech Republic, Romania, Sweden, Swiss and Hungary), at the address indicated by the Customer, only after regular payment of the Order sent to Cruna. In compliance with the provision contained in art. 61 of the Consumer Code, Cruna will deliver the products within and not more than 30 days from the day the Customer sent the Order.
In certain circumstances, for example during sales periods or the closure of the business, delivery times may vary. The Seller shall not be held responsible for delays in delivery that are not connected to its fault or negligence. To this extent, the Seller shall be exempt from responsibility for delays due to force majeure, strikes, natural disasters, occurrences related to Customer procedures, and any other occurrence relating to the provision of delivery services or any other circumstance outside its control.
Customers are encouraged to do everything in their power to facilitate the delivery of the Order, making themselves available for receipt or delegating to a third party.
The courier will make a first attempt to delivery the Order at the address indicated by the Customer. Where the outcome of the delivery is negative, the courier will make a further delivery attempt the following day. If this second attempt is also unsuccessful, the courier will leave written notice containing its contact details and the pick-up point where the products can be collected. If the Customer does not collect the products from the pick-up point within 10 (ten) days, the ordered products will be returned to the warehouse. Customer Service will contact the Customer to agree whether or not to proceed with a new shipment of the ordered products or to refund the relative payment.
At the time of delivery, the Customer must verify the exactness of the number of the parcels and the integrity of the external packaging. In the event that the Customer finds anomalies with the delivery, for example in relation to the number of parcels or damage to the external packaging, the Customer must conditionally sign the delivery document and contact the Customer Service. In the event that the Customer fails to do so, the Customer will not be able to bring a claim in relation to the delivery, save for as provided under article 9 below in relation to hidden faults and in respect of any applicable consumer protection law.

7. RIGHT TO RESCISSION AND RETURN OF THE PRODUCTS
Within 14 (fourteen) days from the date of delivery of the Order, the Customer may exercise the right of rescission provided for in Article 52 of the Consumer Code, with no penalty and without having to provide any reason (“Return”).
In order to activate the procedure for Returns, the Customer can: (i) access his/her profile, (ii) go to the “Order history and details” section, (iii) select the product to be returned and (iv) click on “Request Return”. Alternatively, he/she may contact Customer Service by telephone or by email requesting the use of Cruna return procedure.Dopo multipli recessi e resi da parte di un Cliente, il Venditore potrà riservarsi di decidere se accettare o meno un Ordine da parte del medesimo Cliente.
After multiple returns from the same Customer, the Seller may reserve to decide whether to accept or not an Order from the same Customer.
During the return request the Customer must contact the courier, in order to agree a date and time slot in which the pickup will be made. The collection of the returned goods must occur within and not after 14 (fourteen) days from the exercise of the right of rescission.
Following the above-mentioned return request, the Customer will receive an email for the return receipt and the Tracking Number, to trace and check the shipment's progress.
The purchased goods must be in perfect condition and in their original packaging, with the label and all the documentation received. The return costs will be charged to Cruna.
If the cancellation procedure is completed according to the conditions above, the price paid by the Customer for the returned products will be refunded within the term of 14 (fourteen) calendar days starting from the date in which Cruna is informed of the cancellation request.
Cruna can withhold reimbursement until it has received the cancelled goods or until the consumer has demonstrated that he/she has shipped the goods, whichever occurs first. The Seller will make this refund using the same means of payment used by the Customer for the initial transaction unless otherwise expressly agreed with the Customer and provided that this does not result in additional costs for the Customer.
To this end, the Customer authorises Cruna to keep its bank details and payment data on file for the time necessary to exercise the right of withdrawal.
Cruna return process can only be done in Italy
8. CONDIZIONI DI INTEGRITÀ PER LA RESTITUZIONE
According to Article 57 of the Consumer Code, the Customer can return an item purchased on the Site only if it is in the same condition as when it was received. The Customer must then ensure that:
- the item has not been dirtied or been washed;
- the item keeps all labels, tags and warranty seals on the item when checking the quality and original finishes;
- the item has not been modified in any way;
- and in general when the item is used according to the normal diligence and in any case only within the limits to establish its nature, characteristics and operations (e.g. if the clothing item was worn rather than just being tried on).
In particular, all items must be returned in their original boxes, in their original packaging, which is considered an integral part of the article.
In case the damaged, incomplete and/or deteriorated goods are returned and/or the conditions of use are not compliant with due diligence, notwithstanding the right to rescission, the Customer will be charged the sum corresponding to the decreased value of the goods. In such cases, Cruna will promptly notify the Customer of the damage and non-conformities found when receiving the items. The amount charged to the Customer, which in any case cannot be higher than the price paid for the purchase of the item, will be deducted from the Customer's refund.

9. GUARANTEE FOR DEFECTIVE AND NON-CONFORMING PRODUCTS
The Seller assumes responsibility for every defect in the Products. The Seller guarantees the Customer that Products sold are not defective and that they conform to what has been set out in the Terms and Conditions, that is, in particular, that the Products:
- conform to the description provided on the Site and possess the qualities of the Products that the Seller has presented to the Customer as a sample or model;
- are appropriate for the purpose that goods of the same kind are normally used for;
- possess the usual qualities and characteristics of goods of the same kind, and that the Customer can reasonably expect, taking into account the nature of the good.
For technological reasons, neither Cruna, nor the Site can guarantee that the visualisation of the colours on the screen will always be accurate. Marginal differences between the description of the Product on the Site and the actual characteristics of the Product will not be considered cause for non-compliance of the Product for the purposes of the present Contract.
The guarantee of conformity of Products sold on the Site lasts for a period of 2 (two) years from the date of receipt of the Products on the part of the Customer.
In the event that a non-compliant Product is delivered, the Customer may return the product within the terms of the rescission period referred to in art. 7.
10. PERSONAL DATA PRIVACY AND PROTECTION PROVISIONS
The collection and processing of data is carried out to manage and execute present and future purchase Orders and, in particular, for the fulfilment of the obligations arising out of these General Sales Conditions.
11. APPLICABLE LAW AND JURISDICTION
These general sales conditions are governed by Italian law.
All disputes relating to the present Terms and Conditions and the relevant Contracts made under the same rules will be recognised by the competent Court in the place of domicile or residence of the Customer, based on the applicable law, or, upon option of the Customer, the Court of Vicenza. The possibility of promoting the extra-judicial resolution of disputes is guaranteed, as set out by articles 66 and 141 of the Consumer Code.

For every communication, notification or complaint relating to an Order and to the application of these Terms and Conditions of Sale, the Customer will be able to contact the Customer Service at the address Customer Care or via email to: firstname.lastname@example.org.
